Bihar Police told the Supreme Court on Thursday that Superintendent of Police (SP) Vinay Tiwari, who arrived in Mumbai on August 2 with advance notice to the Mumbai Police. He was detained by the Mumbai Police in the name of Quarantine. On the other hand, the Bihar government in its reply filed in the Supreme Court said that Sushant falls under the jurisdiction of Bihar Police to investigate the case.
Bihar Police on Thursday filed a reply to a petition filed by actor Riya Chakraborty seeking transfer of Sushant Singh Rajput case from Patna to Mumbai. SP Tiwari arrived in Mumbai to investigate the FIR lodged under sections like abduction and abetment to suicide against Riya Chakraborty by Sushant Singh’s father KK Singh in Patna.
In its reply filed in the apex court, Bihar Police also alleged that the 4-member SIT of our police officers who reached Mumbai on 27 July was prevented from investigating them.
The Bihar Police, in its court filing, said that the Inspector General of Police (IGP) had requested the officials of Mumbai to expel IPS Vinay Tiwari from the quarantine. However, it was unfortunately disregarded by him.
Bihar Police said that it is mandatory for a police officer to file an FIR and proceed with the investigation. Only after this investigation is completed will the police officer be able to present the report before the court concerned.
The ANI has a copy of the affidavit with the Bihar government. Accordingly, the Bihar government said that the Station House Officer (SHO) is obliged to file an FIR and expedite the investigation. During the investigation, it cannot be said that the SHO does not have territorial jurisdiction to investigate the matter.
